Conceptual Developments in the Legitimacy of Government in Modern State Theory and Their Application to the Iraqi Constitution

Abstract

This study examines the conceptual evolution of governmental legitimacy in modern state theory and traces its transition from traditional forms of legitimacy based on domination or symbolic authority to a multidimensional conception grounded in constitutionalism, democratic procedures, the protection of rights, effective governance, and international standards. It applies this framework to the Iraqi constitutional experience, particularly in the period following 2003, when recurrent crises in government formation, contested interpretations of the Constitution, and declining public trust challenged political legitimacy. Using descriptive, analytical, and comparative methods, the study analyzes the 2005 Constitution of Iraq, the 2004 Law of Administration for the State of Iraq for the Transitional Period, relevant legislation, national judicial practice, and international human rights standards. It concludes that governmental legitimacy in Iraq extends beyond the formal legitimacy conferred by elections and depends on the interaction among constitutional order, the protection of rights, institutional effectiveness, and public trust.
